{"id":2680,"date":"2026-05-22T17:07:01","date_gmt":"2026-05-22T21:07:01","guid":{"rendered":"https:\/\/plumayespada.online\/?p=2680"},"modified":"2026-05-22T17:07:03","modified_gmt":"2026-05-22T21:07:03","slug":"cij-reconoce-derecho-a-la-huelga-protegido-por-oit-convenio-87","status":"publish","type":"post","link":"https:\/\/plumayespada.online\/en\/cij-reconoce-derecho-a-la-huelga-protegido-por-oit-convenio-87\/politica\/","title":{"rendered":"Fallo hist\u00f3rico de la CIJ: el derecho a la huelga est\u00e1 protegido mundialmente por el Convenio 87 de la OIT"},"content":{"rendered":"<p class=\"wp-block-paragraph\">En una resoluci\u00f3n que marca un hito para el derecho laboral internacional, la <strong>Corte Internacional de Justicia (CIJ)<\/strong>, el m\u00e1ximo \u00f3rgano judicial de las Naciones Unidas, concluy\u00f3 este jueves que el <strong>derecho a la huelga<\/strong> forma parte inseparable de las garant\u00edas reconocidas por el Convenio n\u00fam. 87 de la Organizaci\u00f3n Internacional del Trabajo (OIT).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En una opini\u00f3n legal no vinculante, pero de enorme peso jurisprudencial, la Corte sostuvo que, aunque el texto original adoptado en 1948 no menciona expresamente la huelga, la interpretaci\u00f3n de buena fe del tratado demuestra que la <strong>libertad sindical incluye la protecci\u00f3n del derecho a paralizar actividades<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No obstante, la CIJ aclar\u00f3 que esta interpretaci\u00f3n internacional no define el \u00abcontenido concreto, el alcance o las condiciones de ejercicio\u00bb, dejando los detalles de su aplicaci\u00f3n en manos de la legislaci\u00f3n nacional de cada Estado.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">El fin de una d\u00e9cada de bloqueo institucional en la OIT<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">El fallo de La Haya llega para resolver un \u00abempantanamiento\u00bb hist\u00f3rico. Durante d\u00e9cadas, los \u00f3rganos de supervisi\u00f3n de la OIT sostuvieron que la huelga era vital para que los trabajadores defendieran sus intereses. Sin embargo, en <strong>2012, el grupo de empleadores cuestion\u00f3 esta interpretaci\u00f3n<\/strong>, argumentando que los Estados nunca la incluyeron de forma expl\u00edcita.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Esta disputa paraliz\u00f3 los mecanismos de supervisi\u00f3n laboral de la organizaci\u00f3n, obligando al Consejo de Administraci\u00f3n de la OIT, en 2023, a solicitar la opini\u00f3n consultiva de la CIJ.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sindicatos celebran: \u00abLa huelga pac\u00edfica no es un delito\u00bb<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La decisi\u00f3n fue recibida con entusiasmo por el sindicalismo global, en un contexto donde las huelgas y protestas enfrentan una creciente criminalizaci\u00f3n a nivel mundial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La <strong>Internacional de Servicios P\u00fablicos (ISP)<\/strong>, federaci\u00f3n sindical mundial, calific\u00f3 el dictamen como un espaldarazo vital para hacer que los gobiernos rindan cuentas. Su secretario general, Daniel Bertossa, fue contundente:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>\u00abNuestra libertad de parar nuestro trabajo siempre ha formado parte de nuestra libertad de organizaci\u00f3n. Hoy, la m\u00e1s alta corte del mundo ha afirmado nuestro derecho a la huelga\u00bb<\/em>.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Por su parte, Asad Ur Rehman Aasi, l\u00edder sindical de Pakist\u00e1n y miembro de la ISP, destac\u00f3 el valor humano del fallo: <em>\u00abLos trabajadores van a la huelga cuando se ignora el di\u00e1logo y se imponen decisiones. Esto recuerda a gobiernos y empleadores que la huelga pac\u00edfica no es un delito\u00bb<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00bfQu\u00e9 pasar\u00e1 ahora con el derecho a la huelga?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aunque el fallo de la CIJ clarifica la norma internacional, la aplicaci\u00f3n pr\u00e1ctica requerir\u00e1 trabajo. La OIT deber\u00e1 establecer directrices claras, y se espera que el <strong>Consejo de Administraci\u00f3n de la OIT en noviembre de 2026<\/strong> sea el primer escenario para definir los siguientes pasos a escala global.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dado que los trabajadores de los servicios p\u00fablicos suelen enfrentar las restricciones legales m\u00e1s severas, la ISP ha creado un grupo de trabajo jur\u00eddico especializado para estudiar c\u00f3mo se aplicar\u00e1 esta resoluci\u00f3n en sectores estrat\u00e9gicos.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Un derecho a la huelga reconocido globalmente<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">La decisi\u00f3n de la CIJ no es un hecho aislado, sino que refuerza una tendencia jur\u00eddica mundial en defensa de los trabajadores. Actualmente, <strong>casi 100 pa\u00edses reconocen el derecho a la huelga<\/strong> en su legislaci\u00f3n superior (Constituciones). Adem\u00e1s, est\u00e1 respaldado por:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Comit\u00e9 de Derechos Humanos de la ONU:<\/strong> Reconocido desde hace m\u00e1s de 25 a\u00f1os dentro del Pacto Internacional de Derechos Civiles y Pol\u00edticos (PIDCP).<\/li>\n\n\n\n<li><strong>Uni\u00f3n Europea:<\/strong> Protegido por la Carta de Derechos Fundamentales y reafirmado por el Tribunal de Justicia de la UE.<\/li>\n\n\n\n<li><strong>Am\u00e9rica Latina:<\/strong> La Corte Interamericana de Derechos Humanos (CIDH), en una opini\u00f3n consultiva de 2021, lo catalog\u00f3 expl\u00edcitamente como un <strong>derecho humano fundamental<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u00abLos tribunales pueden aclarar las normas, pero no consiguen el cambio por s\u00ed solos.
